Antitrust Law Daily Wrap Up, CONSUMER PROTECTION NEWS: FTC Issues Report on Dodd-Frank Debit Card Developments, (Dec 28, 2012)

    By Sarah Borchersen-Keto

The FTC said it has not uncovered any evidence that payment card network companies have taken steps to diminish the ability of small banks and credit unions to successfully compete with large financial institutions in the debit card issuance market.

The FTC’s Report on Activities Related to Section 1075 of the Dodd-Frank Act notes that while there is no evidence this type of conduct is occurring, “we will continue to collect and evaluate information related to this concern.” Section 1075 of Dodd-Frank introduced a number of changes in debit card regulation.

The report to Congress, released on December 26, also noted that FTC staff has begun an initial investigation into whether certain payment card network rules may violate Section 1075 or Regulation II, including issuing a request for information to one payment card network. “FTC staff continues to assess whether any payment card network rules and fees may operate as a penalty inhibiting merchants’ routing or otherwise violate Regulation II,” the report stated.
