Six organizations were denied tax-exempt status for failing to qualify under Code Sec. 501. In the first, third, and fourth cases, the organizations were operated to benefit private interests of members which was contrary to exemption under Code Sec. 501(c)(3). In the second case, the organization’s activities constituted participation/intervention in political campaigns, which is not an exempt purpose under Code Sec. 501(c)(3). In the fifth case, the organization did not meet the operational test under Code Sec. 501(c)(4) because it operated to maintain common areas and facilities primarily for the benefit of its members and the developer/tenants. In the sixth case, the organization failed to qualify under Code Sec. 501(c)(4) because it restricted its common areas and facilities to members, their families and guests. However, in all the cases, the organizations were denied tax-exempt status because they did not qualify for exemption under Code Sec. 501.
