Sears, Roebuck and Co. and Kmart Corporation have agreed to dismiss their state law claims in the multidistrict class action litigation against Panasonic, Samsung, Toshiba, and other cathode ray tube (CRT) manufacturers for an alleged international price fixing conspiracy, in a stipulation and proposed order of dismissal filed yesterday in the federal district court in San Francisco. Target Corporation filed its own stipulation on November 5 (In re Cathode Ray Tube (CRT) Antitrust Litigation, Conti, S.).
The retailers had filed suit against numerous CRT manufacturers, asserting claims under the Sherman Act and various state antitrust and unfair trade practices laws. They alleged that they were indirect purchasers of CRTs made by the defendants that were ultimately incorporated into finished products.
The retailers voluntarily agreed to dismiss the state law claims in part because the state statutes did not confer standing on indirect purchasers. However, the plaintiffs will continue to proceed with their claims against the defendant manufacturers under the Sherman Act.
