Sears, Roebuck and Co. and Kmart Corp. have agreed to dismiss Mitsubishi Electric Corp., Mitsubishi Electric Visual Solutions America, Inc., and Mitsubishi Electric US, Inc. from allegations that the companies and other cathode ray tube (CRT) manufacturers engaged in an international price fixing conspiracy. The stipulation of dismissal was filed on August 12 in the federal district court in San Francisco (In re Cathode Ray Tube (CRT) Antitrust Litigation, Dkt. 07-5944 SC).
The retailers filed suit against various CRT manufacturers, asserting claims under the Sherman Act and various state antitrust and unfair trade practices laws. They alleged that they were indirect purchasers of the price fixed CRTs, which were made by the defendants and were ultimately incorporated into finished products.
