By John W. Arden, J.D., LL.M.
A multimedia messaging services provider failed to state a federal antitrust claim against AT&T Wireless Services, Inc. because the provider did not allege that it and AT&T Wireless were participants in the market in which its injury allegedly occurred, the U.S. Court of Appeals in San Francisco ruled (Davis v. AT&T Wireless Services, Inc., April 17, 2014, Per Curiam). Dismissal of the antitrust claim was upheld.
In addition to failing to state a federal antitrust claim, Bruce Max Davis, multimedia messaging service companies, and other individuals waived any challenge to the dismissal of their state law claims by failing to argue that these claims could survive independently of the federal antitrust claims, according to the Ninth Circuit.
The federal district court in Los Angeles did not abuse its discretion in denying the plaintiffs a third opportunity to state a claim in the absence of additional facts that could be alleged to save the complaint.
The case is No. 12-55985.
