The Canada Competition Bureau has updated its Merger Review Process Guidelines, adding new instructions for the production of electronic records for merging parties responding to supplementary information requests. The instructions were updated following the recent publication of the Competition Bureau’s Guidelines for the Production of Electronically Stored Information and are located in the appendix of the Merger Review Process Guidelines.
The Merger Review Process Guidelines set forth the Competition Bureau’s approach to administering the two-stage merger review process under Canada’s Competition Act. Supplemental information may be requested by the Competition Bureau for transactions that are complex or raise significant competition concerns. The instructions under the Merger Review Process Guidelines were updated in accordance with the Production of Electronically Stored Information guidelines, which were published in April 2015 and set forth the Competition Bureau’s preferred standard format for receiving electronically stored information during inquiry or investigation under the Competition Act.
